Stop payment of cheques.
My landlord made me sign rent agreement with locking period of 6 months and 2 months security deposit. He also asked me to provide 6 month pdc cheque on the day when i was supposed to move in. Now he is refusing to fix/service ac,fridge or broken door locked which he promised to do earlier. What can i do now.
you can do the same and adjust the same in your rent. other wise you can file suit for recovery of charges due to breach of contract. It is better you settle the same with him and keep legal recourse as a last resort
If he had committed to fix all of this at his expense in terms of the rental agreement, serve him with a legal notice calling upon him to act immediately. In he still falters, deduct the expenses you incur in getting these articles repaired, from the rent which you have pay to him In future.
First you did make a great mistake by giving PDC.. It is nothing but a bondage and that too for a renting a property.
Refer the rent agreement. I am sure there must not be anything to safeguard your interest in the event the services goes out of order.
Somehow spend six month s and then leave this premises and next time do not give PDC.
Till then send him a written notice seeking maintenance of the non functional furnitures/appliances.
I have already provided him pdc cheques and if the cheque bounces i may have to face legal consequences. Also he/broker is not providing me rent agreement copy his pan. Is there a way out. Only proof i have of non functional ac is a photo of it before i moved in. Please help
do you have in writing from landlord that he would fix ac, fridge , broken door
send letter to landlord by speed post AD to repair the said household appliances as promised by him
Issue a legal notice to the landlord asking copy of agreement, and further repair of the items as promised at time of shifting. If he fails you can seek your refund and can leave the premises. Further make an stop payment of PDC.
you are entitled to copy of your rent agreement
send email / letters to landlord to provide you rent agreement copy for your records , also repair the appliances as it is broken since time you moved in
Sir issue notice, if the landlord fails to undertake repair you can seek your PDC back along the compensation and file a complaint in police station against landlord for cheating , breach of trust and intimidation using PDC.
Report this harassment being meted out to you to the local Police and seek their intervention.
Make a complaint against both your landlord and the broker.
the rent agreement if registered can be received through sub registrar office. Other wise send a legal notice to the owner to provide you the same.Without court case there is no other way. You can also receive the said charges even if you leave the premises and expiry of agreement.
start written communication with the landlord regarding a copy of the agreement, PAN, Ac fault, broken door etc
you have two options
1. stop cheque payment, it will trouble you with a case but he will present all documents in the case else you can force him to submit
2. now make payment and after six months, make payment deducting your expenses (AC, door erc) and let him recover the same from you
you are consumer and you have all the rights as consumer in case your landlord is not behaving as per the agreement even if it is a verbal agreement you can go to consumer forum in this regard and send notice to the landlord before moving to the consumer forum that he will be responsible for all the legal expenses After sending notice and filing the consumer complaint in the consumer forum in case you do not receive reply to the notice then file your complaint with the consumer forum and claim the compensation for the mental agony and legal cast
Tenants cannot install a permanent air conditioner
without written permission from the landlord.
After looking into the agreement we could further advice you the legal recourse available to you.
You issue a legal notice and instruct him to fix all the defects observed within a fixed time or refund your advance amount.
If there's no response nor he is not complying then you may plan to take legal steps to solve the problem.
