• Non-creamy layer certificate validity

Hi,

Is mother's non creamy layer certificate (OBC) valid for me apply for UPSC exam age relaxation? 

Or is it necessary for father to apply for such certificate? Simply, is such certificate owned by either of the parents is valid?

Dear client,

NCL certificate will issue in your name on the basis of both parents total income. Their certificate is not valid for you.

You need to apply for ncl certificate for yourself based on the income and post of your father there certificate won't be valid for you.

The parent who is earning his earning has to be taken into consideration. If both the parents are earning then both their earnings are to be taken into consideration.

Your father should apply for and obtain OBC NL certificate

 

You need your  matriculation or secondary school leaving certificate. ... Certificate supporting OBC/SC/ST status (if applicable): Certificate issued by the District Officer/Sub-divisional Officer/any other officer as authorised by the government to issue such certificates of the district in which your parents reside.

The applicability of OBC certificate is based on the income of the parents.Apart from the annual income, if the parents are receiving any other means of income, then that income will also be considered to consolidate the sum of 8 lakh,Income received by doing farming and agriculture will not be taken into account..

Dear Sir,

 It is only a misconception that there is a validity period of OBC-NC Certificate. Thus OBC-NC Certificate is absolutely valid even if issued for more than3 years ago but with a self - declaration given by the Candidate as per the format mentioned in the OM.

For Physically Challenged, upper age is relaxable by 10 years for General Category, 13 years for OBC(Non Creamy Layer) and 15 years for SC/ST category. ... (2)Relaxation for OBC (Non Creamy Layer): Upper age limit is relaxable by 3 years to only those OBC candidates belonging in 'Non-Creamy Layer'.

The OBC Non creamy layer for the kids of government employee is decided on two factors : By post or by class

  • If anyone of, father or mother are direct recruited class 1 servants than their children won't be eligible for NCL. But if he/she is promoted to class 1 then the kids will be eligible
  • If both of the parents are class 2 than their kids won't be eligible for OBC qouta but if only one of them is than the kids would be off from creamy layer and they can avail benefits of qouta
  • If father was recruited direct to class 2 position and than promted to class 1 before age of 40 than it would be no longer NCL. However this scenario only applies to father not the mother

The government servants who doesn't fall under this category are all non-creamy layer.

1) for your NCL - OBC certificate both of parents income are counted for last 3 consecutive years. If both the parents are government employees than its compulsory for you to show their income.

Dear Sir,

 

Income of your parents only will be calculated. Thus you can get the certificate.

The government will consider the parents’ status to determine “creamy layer” instead of status of the candidate applying for the job. In case of women candidates, too, the parents’ status will be considered and not the husband’s status.

Please note that there is no validity period of OBC-NC Certificates.
The Department of Personnel & Training, clarified its position Govt. of India vide OM No. 36033/4/97-Estt.(Res.) dt. 25th July 2003.

The Non creamy layer certificate pertaining to you only will be applicable for you and not your mother's, if your mother has obtained a certificate for you on the basis of her own status, then you can very well utilise the same as applicable.

Actually the OBC NCL status will be accorded on the parents' status only and not on the single parent while the other parent is living.
