betting or gambling is illegal in india .According to the Public Gambling Act (1867), all kinds of gambling in India are illegal. but there is no law that makes online betting illegal .

2) delhi high court has held online gaming portals are essentially a substitute for traditional casinos, since websites operate a common gaming room where members interact and place bets. It also noted that the degree of chance increases in case of online games and the degree of skill used in these games is questionable.

Further, the court also noted that there are several service providers who are offering such online skill-based games for free, but when service providers take commission on the prize winnings, it becomes similar to virtual casinos or game houses which are illegal in the states where gambling is prohibited. Therefore, the court ruled that such online business activities would not be protected under Article 19(1)(g) of the Constitution of India.

The Indian gambling law does not specifically ban online casinos but it does not allow playing in an online casino, either. The Indian government does not give out licenses to operate online gambling sites in India. It would be fair to say that it is not illegal for an Indian citizen to play in an online casino.

1) You can start under online casinos to run legally which are Goa, Daman and Sikkim state laws in India, whereas in rest of India it's totally banned.

Dear Sir,

Not all the states have the legal right to run it. We can see that 3 states in India allow casinos to run legally which are Goa, Daman and Sikkim whereas state like Maharashtra has totally banned the operation of the casinos. ... Gambling in India is heavily restricted except for selective categories including lotteries and horse racing.

Gambling is a state subject, and only states in India are entitled to formulate laws for gambling activities within their respective states. The Public Gambling Act of 1867 is a central law that prohibits running or being in charge of a public gaming house.

Only three states allow casinosGoa , Daman and Sikkim

Online gambling is in its infancy in India, but Sikkim planned to offer three online gambling licences in 2010. This failed despite India being the most sought out country for online gambling

Therefore you may look for the set up accordingly in the permitted states.
