My home is around 30 ft from the road The entry way to my home
/property is very narrow around 3ft only
Only bikes can go in.
 Is there any legal option to get the neighbors on both sides to sell some adjacent land to widen it at reasonable price. Is right of ease APPL cable in such cases?.This property is in Kerala.

See if there is a way and same you are using then you cannot.claim esasement over the way to widen it you can talk to your neighbours for same and convince them to sell for a reasonable price.

you have to file a civil case for getting your easement rights. Do you have any other path way to enter into your property?. You have to prove your usage in others property for easement rights.

  1. As per the information mentioned in the present query, makes it clear that you want to settle with the neighbour for widening of the entry area of your home, if I have understood it rightly.
  2. There is wrong in it going for the same with the consent of he neighbour and after paying an agreed amount to them.
  3. But, if they say no then you may not have any legal obligation on them to make them to get agreed to your justified need.
  4. In this case, there may be a right to easement will be there, but the same can only be exercised by the court of law only.

You may negotiate the neighbours to sell the land as per your convenience. It they are not in confirmity with you, you may use the specific relief provisions against them.

If there's no other way then you cannot compel your neighbors to sell their land to you as a law.

If at a request they are willing to sell then you can buy it but remember that if it is a public road then you cannot claim ownership over it.
