I am appearing for UPSC civil service exam(CSE). UPSC CSE forms are out already. For OBC NCL category, I was replied that the income of the class 3/class c group employees doesn't matter but what matters is their status of Job and thus I am supoosed to be eligible for the OBC NCL reservation. My problem is that the office I approached for the OBC NCL certificate says that my father's income( total gross income) exceeds 8 lacs p.a and hence their computer is not accepting the application. I have tried caling UPSC helpline numbers but none picked up the calls. Kindly clear my doubt of how am I supposed to avail the OBC NCL benefit for UPSC CSE without having OBC NCL certificate.
See.you need to get the Certificate then only you can avail the benifit in your case when income is not criteria they do not have to choose same.
If office still fails to give you obc NCL you need to file a writ before highcourt for direction to office to grant you a certificate.
ask the authorities to give in writing that you are not eligible for OBC NL
2) your father income is immaterial as he was working as class 3 officer under state govt
3) as against refusal of authorities to give you OBC NL certificate make representation before collector .
your father is working in class III under Central govt./State govt. then you will come under OBC-Non Creamy layer irrespective of income of your father from salary.
But if your parents have any income from other sources (other than salary income and income from agriculture ) is more than the prescribed limit (at present 8 lakh for central govt.) for three consecutive years then only you will come under OBC Creamy Layer.
The said limit is just an slab it has no relationship for your OBC NCL status. You are eligible for the same
The sad part is that the government officials have never heard of the provisions for reservation regarding class 3 jobs. All they say over and over again is the 8 lacs income limit should not be breached. I'll contact the District Magistrate if the issue isn't sorted out although it will spoil much of my time before the exams. Thank you.
You can also file writ petition for the same in HC.
You should in your written representation enclose OM of 1993 which lays down that only those who have been directly recruited as group A officer or permitted to group A before 40 years of age woukd fall under creamy layer
See contact the DM if the issue is not resolved then you can file a writ can engage an advocate he will take care you can focus on your studies.

The grant of OBC NCL depends on social status as well as income criteria and keeping the whole thing in mind, you are suggested to approach the concerned authorities for grant of such certificate.
The UPSC helpline or their office cannot help you in this regard.
If you want to avail reservation in this regard you have to produce the said certificate.
If the competent authority i.e., the Tehsildar is not issuing the said certificate you may prefer an appeal against his decision before the district collector who will rectify this problem.
Yes You can approach district magistrate/collector to get your grievances redressed.
