• DIvorce decree vs order

Hi,

I got mutual consent divorce in October 2018. I got an order from the court saying, the marriage is being terminated from today with this decree. Is there a separate one page decree that court issues? The entire order is 4-5 pages. I am trying to get remarried and Arya Samaj Mandir folks are asking for one page divorce decree (as opposed to 4-5 page one). I am based in UP.

How long does it take to get the one page decree and what is the procedure?

Hello,

Give them only one page where court pronounced the divorce.

1. The judgement is enough proof of your divorce and copy of decree is rarely needed like while applying visa or preferring an appeal in higher court.

2. So demand of the Arya Samaj is little unusual.

3. However since you eventually would require the copy of the decree , you should obtain it at once.

Both the parties to the suit are entitled to get the copy of a decree.

1) you can ask your ex wife lawyer  to furnish you certified copy of divorce decree 

 

2) in alternative apply for certified copy of decree from registrar family court 

 

3) since family court is over burdened it takes time to obtain certified copy of divorce decree

See file an application for certified copy of decree the court where divorce was granted the court on application and copying fee shall provide same in a week.

See you can get you own certified copy just a simple application before court registery has to be filed they will take copying fee as decided by government and within week provide certified copy of same. Further if you pay something extra.they will get you certified copy same day.

A court decree that terminates a marriage; also known as marital dissolution.

A divorce decree establishes the new relations between the parties, including their duties and obligations relating to property that they own,support responsibilities of either or both of them, and provisions for any children.When a marriage breaks up, divorce law provides legal  solutions for issues that the husband and wife  are unable to resolve through mutual cooperation.

So , divorce order and divorce decree is same thing.

If it is Mutual consent divorce then it cannot be challenged , however in case of contested divorce , he can file an appeal

Dear Client,

Once judgement is passed, court decree is issue in 3 4 weeks which is of single page if court is not over burdened . Apply for certify copy of it, will get in 2 days. Fill certify copy form and submit in court office.

1) You can't remarry before 90 days from this order. Anyhow you have to wait for 90 days and than get remarry. Meanwhile in court to clerk you can ask for one page order copy of divorce.

If the judgment have been passed and divorce have been granted the decree sheet is given in 3-4 days, you can file the certified copy of the Judgment in the concerned court filling section and it will be delivered in 4-5 days..

  1. As per the information mentioned in the present query, makes it clear that you are having the order but not the one page decree with you.
  2. For the same, you will have to inspect the file after filing an application for inspection and see the page no. of the decree so pronounced.
  3. Then file a certified application for the above stated decree. It would 20 to 14 days maximum to get the certified copy of the orders so mentioned in the case.

There are two things, one is decreetal order and another is judgment.

The former is one page and the latter maybe more than one page.

You can approach court with an application seeking decreetal order.
