• Obc non creamy criteria for psu

Sir I belong to OBC caste. My father works in a PSU as a deputy manager. His only source of income is his salary which is 10 lakhs per annum. He is not a class 1 officer. Can I apply under non creamy layer under the government jobs and education institutions? I have heard that salary is not included in the income for considering creamy layer status for PSU / Government employees. Is it true ?

See salary will not be considered for PSU employees only the post will be considered and for that.governemnt of.india has done an equivalence of post in PSU father can get certificate of.same from PSU based on same you can apply.for NCL certificate.

The salary of a public sector undertaking employee should not be taken into account while deciding whether his children are ruled out of OBC reservation by the creamy layer clause, Madras High Court has ruled, 

 

2)The high court has rejected a central government clarification of 2004 that allowed low and middle-ranking PSU staff's salary to be counted while determining their possible creamy layer status while exempting government staff of similar rank.

 

3) since your father is not class I officer you would be entitled to OBC NL certifcate

OBC Creamy layer—-Who has yearly income more than 8 lakhs or Government Employees of greater than class 3 are not eligible for OBC Quota.

OBC Non-Creamy layer—– Who has a yearly income below 8 lakhs or Government Employees of Class 3 or below class 3 officers are eligible for OBC Quota.

Dear Sir,

 

Income of your parents only will be calculated. Thus you can get the certificate.

The government will consider the parents’ status to determine “creamy layer” instead of status of the candidate applying for the job. In case of women candidates, too, the parents’ status will be considered and not the husband’s status.

Please note that there is no validity period of OBC-NC Certificates.
The Department of Personnel & Training, clarified its position Govt. of India vide OM No. 36033/4/97-Estt.(Res.) dt. 25th July 2003.
It is only a misconception that there is a validity period of OBC-NC Certificate.
Thus OBC-NC Certificate is absolutely valid even if issued for more than 3 years ago but with a self - declaration given by the Candidate as per the format mentioned in the OM.

You have rightly heard that the salary income of the government employees are not taken into account for computing the annual income of the family to determine the OBC NCL status/category.

Since your father is not a class I Officer, you are entitled to to the reservation under the said category.
