Dear Client,

See finding out LOC is issued or not is very difficulty till you have contact with senior police officers as the SP/Commissioner along IO only have information regarding same so if IO of the case is willing to help he can tell you. Since this information is sensitive and about ongoing trial even inRTI it wont be disclosed.
See if look out notice is there as from outside he cannot apply for anticipatory bail , he needs to surrender and then obtain a regular bail or as soon as he is in India on same day he need to file for anticipatory bail though in 498a cases there is rarely LOC or direct arrest now so he can talk to IO of the case and then when he comes to India can take an Anticipatory bail. There are minimal chance there would be any circular.
Further he can file a quashing petition before high court to quash the FIR against him.

Sir first of all thank you for great rating without understanding the answer given. See LOC is confidential document and under the RTI law also there is exceptions are there when the information can be denied. So yes it law not there willingness and confidential information can be denied under RTI also. But still you can check with FRRO, court file, SP office or immigration office if any LOC is issued or not.
You can engage the services of an advocate in the city where the case is pending and confirm the status of the case including pendency of LOC or any orders passed by district collector on the recommendation by the concerned superintendent of police in this regard.
You can find out from the police station whether any FIR has ben filed against you or not and the status of the said case.
2) if any LOC has been issued against you IO can inform you about the same
if any FiR is registered against your son then notice would be issued to your son to record his statement
2) your son can apply for and obtain anticipatory bail from sessions court
3) you can find out from police station whether LOC is issued against your son
4) also find from FRRO office whether LOC is issued against you
You cannot expect a LOC just because she has lodged a criminal complaint.
The police will take steps to enquire about the case and register FIR only if the offence is made out.
After that the police will havce to put a note recommendingn approval of LOC only when they are confirmed that the accused person is intentionally avoding the summons or has fled the country after the FIR was registered or any other ground.
For this the complainant has to follow it up vigorously with the police and put pressure on them to recommend LOC.
Whatsoever, you may engage the services of an advocate and ask him to probe intio the matter confidentially and give the report to ascertain the facts.
you need to check the same with the authority which has issue the same. Your lawyer can find out the same.
1. It is not sure whether any FIR is registered against your son or not and if yes whether he has still absconding or has taken bail.
2. Unless and until a FIR is registered and the person named therein has not submitted himself before the court by taking bail, there is no scope for issuance of LOC.
3. If this criteria fulfils in your case and you are still uncertain on LOC then get in touch with FRRO or Ministry of External Affairs. You can seek information by sending application under RTI as well.
