• Agricultural land GPA

Hi, I am going purchase agricultural land from person ‘B’. He bought this property from person ‘A’ and he reigistered on his (person ‘B’) name from registration office, but he didn’t get ammendament and land passbook from Mandal Revenue Office.

Now I am going to buy this property from person’B’. 

Person ‘B’ saying that getting ammendament and land passbook from Mandal Revenue Office will Be delay. 

Person ‘B’ is saying that pay the full amount of money And he will do GPA on my name.

My question: 
1. Is GPA valid without ammendamentation and land passbook from Mandal Revenue Office. 

2. Can I pay full amount and go for GPA (or) can I wait until person ‘B’ gets ammendament and land passbook from Mandal Revenue Office.

A person who owns land can only sell it to others. Purchaser gets the same right which the seller has and if the seller has no right or has insecure right then the purchaser also gets no right or insecure right. Title Deed, Pattadar Pass Book, 1B register contains the details of the land owner. See all these three records to know whether the seller is the real owner. Encumbrance Certificate also shows the name(s) of the owner(s) and earlier transaction on this land

You can transfer on your name directly from Person A.

If time permits, wait Person B transfer to his name for more secure way

1. You need a sale deed , GPA after Suraj lamps judgement not valid instrument of transfer of unmovable property.

1. GPA is not the title document hence reliability on the GPA is not advisable.

 

2. You better wait for the transfer of revenue records on the seller's name and then go for registered sale deed on your name.

You need to inquire the same at revenue office. GPA can be done but If the same is not authorized without revenue office then you will be in problem. Get a insight from revenue office and then if required do GPA.

Dear Client,

Through GPA, no actual ownership acquires. Better ask him to get it mutated and than execute sale deed.

Dear Sir,

Since 2011 the Supreme Court says sale transactions on the basis of GPA are not valid. It is not wise to pay entire amount to him.
