We have purchased the LG SBS refrigerator in june 2015 Worth Rs.78K. In augest 2018 it has some fault, LG service team is tried their level best (Carried faulty device to workshop)for 3 months but they failed to run it and declared it as non-repairable in last month.

As per the area manager and upper management of LG that device is not in warranty so he is ready to provide 55% of bill amount on next device and remaining amount we have to pay. To close this matter we agreed to do so.
Then we choose the refrigerator model which market/Online values is max 65K. As per the company he is going to consider the value of this product for us 89K and we have to pay different amount. 
From last 30 days LG service representative are making Dilatory tactics with us for price issue like collect the quotation or we don't have time for same issues.

So we are not ready to pay this then we write the mail to LG service team and give them 6 reminders but they are not replaying at all.

Now please suggest me to what to do?
1)Should i agree with company policy??(Actually we are not interested to use LG product)
2)We have used this device for 3 years so if we go to consumer court can we get refund of our money??
3)How much time and money required for consumer court??

if you have used the device for period of 3 years you would not get refund of your money 

 

2) further it does not fall within warranty period

 

3) if it is non repairable then  accept company offer of 55 per cent on next purchase 

 

4) cases before consumer forum take 2 years to be disposed of

1. See if product is not in Warrenty then you should agree with them but give them a legal notice so they start working faster or consumer court can be approached.

2. If Warrenty expired you won't get refund of money though company service centre failed to repair same you can get compensation.

3. See it can take around a year or two further money would be according to advocate you engage.

if the said product was in warranty period then you will get the refund from consumer court. If not in warranty period and you have paid charges for repairing still you can get refund from consumer court. You can also go to consumer court after warranty period if the defect is manufacturing defect. Approximate timing of consumer court is 1 to 3 years to the maximum. Fees are variable as per advocate

1)A complaint can be filed by a complainant against the seller, manufacturer, or dealer of goods which are defective or against the provider of services, if they are deficient in any manner whatsoever.

2)You better file your case with the District Consumer Forum and demanding refund of your money along with compensation. 

3)Normally it's 1 to 3 years, but in some states it may take 6 months and in some states more then 5 years.

3. Then you if your dissatisfied with their response then you can approach district consumer court;

1.  First of all you have to ascertain that if the product is still covered within the warranty period, if not then there is no use in approaching the consumer forum because no case is maintainable against the company for deficiency in service for the product whose warranty period is expired.

2.  Less possibilities.

 

3. If you have decided to fight it out through consumer forum, you may better appraoch a local advocate who would be able to guide you properly and also would inform you about the time taken for filing and disposal, based on the prevailing atmosphere.
