• Name transfer in the family property at raipur development authority

We have in joint family and after the separation all the property distributed and make the family batwaranama & notorised the same. I have got one property in raipur development authority commercial plot, which is name of my brother.I would like to transfer the name in RDA what is the procedure?
shall I have to pay the money to RDA as it is only family distribution.

deed of family settlement has to be duly stamped and registered

2) mere notarised deed of family settlement is not sufficient

3) your brother has to execute gift deed in your favour of plot

4) it should be stamped and regsitered

5) then apply to RDA to transfer plot in your name

If you want to transfer the property from your brother you can execute a registered gift deed. For this there is no stamp duty if the transfer is within the close relationship. The applicable registration charges have to be paid before the registrar's office.

If same city than settlement deed between family shall be registered than on the basis of it, property will transfer in your name.

Different city than brother have to execute GIFT deed.

According to your State procedure you have to pay the stamp duty. Normally such stamp duty will be very low since it is family property. Better consult local lawyer or any staff of concerned office to get it transfer in your name easily.

Check at sub registrar office, how much stamp duty payable on family settlement.

Stamp duty is less in family settlement/partition.

After registration only such distribution is valid.

The partition deed should be drawn on a registered document only

The RDA may not accept the unregistered family arrangement or partition deed for transferring the name.

In Raipur development authority charges 10% for name transfer, but as we have family settlement deed & all property is in same city (Raipur).
