• Resignation from bank

Working in sbi aa clerk....since 6 years....got new job in state govt.....need to join in 15 days ...no time for notice period .....got 6 lakhs of car loan as staff...n not got surplus cash to pay it....how can i resign from job?

You have to submit your resignation letter

2) it has to be accepted by bank

3) serve notice period failing which disciplinary action can be taken against you

4) you cannot join job in 15 days time

Notice period is served after giving the resignation and not before it. The Minimum notice period for a SBI Clerk is 14 days.

Sir you have to give resignation from the department stating other reason as you have not taken NOC so technical resignation cannot be taken, further you have to ask the appointing authority to pay in lieu of the notice period and clear of the bank loan, if the department excepts you application then only you can be relieved.

As and when you resign from the bank the bank might ask you to pay the loan that was given to you at the staff rate.

Yes you can ask the bank for some extension.

You can ask your superiors to relieve you from services by waiving off your notice period as that is the only option to terminate your employment with your employer without any ramifications.

If you fail to serve notice period your employer can initiate legal proceedings against you for recovery and may also file an FIR against you for dual employment.

So, best way is to settle this with your employer and not join any other job until and unless it is resolved.

You can tender your resignation intimating your decision to quit the job in writing and send the same by registered post or hand it over in person by obtaining an acknowledgment for it.

In the letter you may mention your willingness to pay the salary amount as compensation towards the waiver of the mandatory notice period.

You can give an undertaking to repay the outstanding vehicle loan on terms as made by the bank in that regard

CAN I ASK FOR STATE(KARNATAKA) FOR EXTENSION IN JOINING? You can request the government authorities to defer your joining date by another three months owing to the revilement from the bank and as you said the car loan can be converted to commercial rate as well.

Yes a extension request can be made and the department yes can give you an extension there are times when extension of month or so is provided in joining period... See the loan can be modified or it would be better if you pay and close it to expedite the procedure.

Yes you can apply to the state govt and you can always talk to the financing bank for foreclosure or convert it to normal loan first and then foreclose it by paying some nominal charges towards the same.

Dear Sir,

You can get both reliefs. The new employer that is state of Karnataka may extend time to join. Secondly your staff loan can be converted into normal loan. The bank cannot force you to pay entire loan amount in one installment. In the developed scenario your request will be considered by both employer failing which you may approach or a civil court whichever may appropriate for getting appropriate relief.
