Thirdly, I advice you you to try it get some documents also from here and there whcih may prove that you were in hospital because of his tortured in you.

1. It is not clear what exactly you want now. If you want amicable settlement then receive a sum of money and dissolve the marriage by way of mutual divorce.

2. if not then lodge a complaint of 498A IPC at local police station and if the crime is committed in Kandi then the local police would register the FIR . Otherwise it may send the complaint to the place where you were physically tortured.

3. Then file a case under PWDV Act claiming maintenance from him which would be around 1/4th of his income.

As you say you filed mutual divorce petition, that's mean he is also ready to give

you divorce. In this situation you don't need any evidences.

But if we see other side of this and he is not ready to give you divorce than file

divorce on the grounds of physical, mental torture.

Mam obtain the treatment document and report from the hospital as you have record there, if police is not registering the case the best thing to do is file a writ petition in high court for registration of FIR or a private complaint directly to the magistrate under 498a, Domestic violence act,406 ,323 IPC . Further seelk maintenance under DV act and also can infrom army officials and seek maintenance directly army has such provision.

Yes it is helpful it is very strong evidence the husband can be punished and the justice can be given it is admissible in court. Obtain copy of complaint and the injury reports and file for physical abuse on husband.

3. You can now file DV case and also police complaint u/s498A of IPC alleging dowry harassment wherein you can pray before the Court to ask the Army Hospital at S.Nagar to submit the related documents to confirm the torture meted by your the then husband on you.

Even now you can restore the complaint to AWWA and also to his parent department in order to make him realise his mistake

You can file DV case against your husband but that you should try to file in Military court and not in civil court than he will recognize what happen after betting to wife and provide all Srinagar evidence and proof along with witnesses of commandos.
