• Fencing of private land in gated community

I own a 2500 sqft villa on a 2900 sqft land in a gated community in Bangalore. I put a three and a half feet wired fencing enclosing my private land. The fence is completely in my land. I was told by the owner of the adjacent villa that bmrda states that the wall cannot be more than two feet. Kindly advice if such a rule exist?

As per Clause 20.8 of BANGALORE MAHANAGARA PALIKA BUILDING BYE-LAWS 2003:

Boundary wall- a) Except with the special permission of the Authority,

(i) the maximum height of the front and side boundary wall shall be 1.5 mts. above the

ground level;

Firslty, Sir, let me tell you that there is no such provision of law which says that you can’t have three and a half feet wall.

Secondly, the land belongs to you as it doesn’t not create any nuisance for anyone out there.

Thirdly, there are very less chances that your wall may create any nuisance to anyone.

Fourthly, if they continuously do so then I ll advice you to file a civil suit before the civil judge for permanent injunction against them to create nuisance for you without any fault at your end.

Yes there is law for villa also. Take permission from authority, what's the

problem. Why you want to go in legal formalities, because your neighbour

should try to file complaint against you.

In gated communities instead of compound wall, fencing or paling will be provided to demarcate the boundaries of properties.

Yes that is right the BMRDA does not provide for a boundary wall of more than 2 feets, and the same will apply to your plot also.

However, if there is no construction on the land and just to marl your boundaries you have installed the fences then the same shall not create much problem and the municipal authority shall not object.

As per Bangalore Mahanagar Palike by laws clause 20.8

Boundary wall- a) Except with the special permission of the Authority,

(i) the maximum height of the front and side boundary wall shall be 1.5 mts. above the

ground level;

(ii) The rear boundary walls shall not have a height of more than 2 mts. above the centre

line of the service road or where there is no service road 2 mts. above the ground level;

(iii) In case of corner plots, the height of the boundary wall shall be restricted to 0.75 m. for a length of 5 m from the intersection on either side. The corners of the boundary wall in such cases shall be rounded off or cut off as indicated in the bye-law 17.0;
