• Distance from the boundary

While constructing a commercial building(170/16 SURVEY NUMBER) by mistake we haven't kept any distance from the neighbors plot. Now he is not giving NOC to submit in the panchayat to get the building number. Actually we bought 38 cents of land from the same survey number 170/16 but when we measured the property now we are getting only 32 cents of land. We lost around 6 cents of land. This neighbour is now having the possession of this 6 cent land. Can we approach the court stating that the boundary shown by him is the not the actual one and can we convince the court we have left the panchayat building rule distance from the boundary if we are considering this 6 cents of land which the neighbour having possession

issue legal notice to neighbour to vacate 6 cents of your land in his possession

2) file suit for eviction if he refuses to vacate

3) neighbour would compromise and give you NOC

If your actual extent of property is less than the extent mentioned in the sale deed, and if you are confirmed that your neighbors have encroached your property to that extent you may file a suit for title declaration, mandatory injunction and for possession of the encroached property.

If the neighbor do not cooperate then you may find relief through court of law.
