• Wrong entry in town survey land register extract

Dear Sir/Madam,
 I and my Mother both are owning an agri land measuring 25 cents and we have a joint Patta for the same in Tamilnadu.There is a tenant dispute in that land and court case is going on for the past 7 years.We already have an extract of town survey where our names are in the Adangal Column
Recently the extracts were updated in the internet and when i checked the extract i saw our joint names and the measurement was also correct but it was given 'GOVT LAND PORAMBOKE' which is really shocking to us.I Immediately approached the Taluk office and gave a complaint to Thasildar, but there is no proper response.My suspecion is that the tenant has joined hands with thasildar.Please suggest me an effective way to delete the entry.Thanks in Advance

Firslty, Sur, whenever a problem like this appears you should file an application for the correction of the same.

Secondly, if they don’t give reply to that then you can also go before the High Court under the Writ of Mandamus for seeking direction to change the same.

Thirdly, you should use that application as a representation in your Writ.

Fourthly, and you have all legal rights over the land as you have been here since more than few decades.

Sir you can file a written complaint with the tehsildar(Taluk officer) and further to the collector for correcting the land records which are mistakenly updated in this way.

if they both fails to take action then in that case file a writ before High court seeing direction for the authorities to correct the revenue records in this regard.

As you already given a complaint in written form to the Tehsildar and neither any reply has been received by you, so, you have an option to approaching High Court by way of a writ of mandamus directing the Tehsil office do cancel the wrong entry and rectify it by putting your and your mother's name as the owner.

hello,

an application should be given in the SDM court for this anomaly detailing the property and the previous owners and now how did you come to possess it and the court case going on.. this will entail hearing of the case. you can further appeal from there.

If you are confident about your title and ownership over the disputed parcel of land and hold the relevant documentary evidence, please send a legal notice to the Tahsildar concerned, and file suit in the district court, if the response is not satisfactory.

1. File proper appeal before the district Collector, with all the relevant documents.

2. ALSO can file appeal before the district Civil court, for declaration.

3. BEFORE doing above, conduct proper Govt. Survey of the Land and obtain report, to verify facts.

hello,

cases related to agricultural lands cannot be filed in a district court. they can only be filed in a revenue court ie the SDM court. this is a very important legal point. act accordingly.

As mentioned earlier, first send a legal notice to the Tahsildar. If there be no proper response, file the suit. Filing a Writ seeking appropriate directions to the Tahsildar also is a good move.

If there is no response from the Tahsildar on your complaint then you may prefer an appeal before the District collector about this and seek his intervention to direct the Tehsildar to clarify the issue expeditiously.

If there is no response even for that then you may file a suit against the Tahsildar for mandatory injunction to remove the adverse findings that 'GOVT LAND POROMBOKE' from its records.

First exhaust the remedies available locally with the district collectorate and then approach civil court for remedy and relief.
