• Solution for Advertisement Cancellation ( Worst Situation ) .

We , 240 candidates were selected for the post of assistant professor in the affiliated and associated college of Abdul Kalam Technical University , Lucknow through written and interview process . 

Opposite party went to division bench ( Service Matter ) of Allahabad High-court ( Writ No : 45869/17) and claimed that - 
1- A combined written can not be done . 
2- Each college has own by-laws so combined written can not be done . 
3- Permission was not from Chairman of BOG n so on . 

Hon'ble High-court has reserved his Judgement after hearing . 

We regular faculty (240+) have been appointed and we were not party in any cases . Many of us were from government and any other colleges of repute in the past .

As per against party - Government lawyer was so weak to defend the case and Advertisement will be cancelled .

Dear Client,

Candidates are necessary party, and without hearing them, any order effecting their appointment will have adverse effect and against principal of natural justice.

Certain cannot be said, if recruitment process will be quahsed till order not delivered or if any oral observation given by court, while argument.

Sir kindly wait till the order since you will be affected parties if the order is adverse you can claim relief on said order, Further you should have given an application when such writ was filed to impaled you people as party as you will be effected by same. Now further course can be decided after the order in the Writ by the high court.

Firslty, anything which can be done can only be done before the appointment.

Secondly, as you all have been appointed then now your post can be cancelled only if they happen to prove some discrepancies in it otherwise not.

Thirdly, it may be applicable if any order come for the next batch not for you all.

Fourthly, you are falling under the theory of law of estoppel. So relax.

In that point of time, you cannot really do, anything, other than wait for the judgment of HC.

If you're dissatisfied with the decision of HC, you can challenge it in Supreme court

Dear Concern,

In case you are of the belief that the government advocate is not upto the mark and he can't contest this case then you all should file an application for impleadment of parties and shall contest this case by hiring an advocate of your choice.

If you do not wish to do this then remember -

(i) even if the government lose this case then they have the power to move to High Court under revision application,

(ii) if they lose the revision application as well then the government can move before the Supreme Court,

(iii) and if the government lose over there as well then still you can come up on your own to save your job at that stage

So don't panic. Unless and until corrupt means have been used to employ you, your job is not going to be cancelled. Any government vacancy or job positing gets cancelled only if -

A. Corrupt means have been used to do the same,

B. Incompetent or unqualified people have been allotted that job despite qualified candidates being available,

C. their have been nuances of fraud in allotting the marks and declaring the final result, and

D. if the proper notification was not given and time was not allotted to submit your application.

If all these things are there then your job cancellation is unlikely to happen. But if you feel that there are chances of losing the case then hire an advocate of your own and contest it.
