• Wrong Survey number during registration of agricultural land

I Mr ABC had puchased agricultural land of survey no X of 2 acres in 2001 from Mr PQR and at the same time registration was done with different survey number Y. But we are on possession with survey number X only till now. But recently another person Mr XYZ has registered the survey number X on his name from Mr PQR without our permission as I was on possession and now where i have to go.
Suggest me solution to regain my land of Survey no X.

In the schedule of sale deed details maps of which survey number is mentioned ??

If only X survey number belongs to mr.p... Then he cannot sell y survey number then it was typographical error.

Was mutation on any survey done.??

I don't see possibility of a retification deed by your seller so

Keep the possesion of the property and file a suit for correction of survey number in revenue records and sale deed.

Also in case Mr. pQr files a suit for possesion than you defend same on ground that property is already sold and you have possession form.years.

Apply to survey office to carry out detailed survey of your land and that of XYZ , for demarcation of boundaries of land

The survey number and details mentioned in schedule shall belong to if it was done with a valid title otherwise it can also be held invalid.

If there is problem in demarcation give new purchase a notice for demarcating land with help of village talati if doesnot agree apply for for demarcation of boundaries in revenue office .

On the basis of MAP enclosed with the sale deed, file injunction suit against PQR and XYZ and file police complain against PQR for cheating and sale of your property.

If the survey number ws wrongly mentioned in the registered sale deed, you may have to get a rectification deed executed rectifying the correct survey number

The vendor has sold the other survey number erroneously similar to your sale deed.

You approach the vendor get the registered rectification deed executed, this requires no additional stamp duty.

Answer:

You can do the following:

1. Issue a legal notice to Mr. PQR;

2. Say to him that Mr. PQR is liable for committing fraud, cheating etc. under IPC and you can very much file an FIR;

3. If he still does not listen you have to approach the court. You can drag both Mr.PQR and Mr. XYZ to court;

4. In court you can hold Mr. PQR for cheating you and creating third party interest.

You need to send a legal notice to pqr asking him about the explanation for the same. He can't deal with 2 people for single agricultural land. If you don't find any resolution.you need to file FIR u/s 420 of IPC against him.

File a suit for correction/rectification in sale deed of survey number citing the earlier marked boundaries in the deed further to declare you owner over that survey number which was wrongly mentioned in the deed.

This is my further response to you:

1. Approach the police station that they have to file FIR under section 154 of CRPC;

2. Also the offences of cheating, criminal breach of trust are punishable offences;

3. If the police don't record then directly file a complaint to magistrate to record your complaint;

4. The civil remedy available to you is to go to Civil Court and file a suit for injunction;

5. Collect all the evidences and lay them before the civil court judge and let him/her adjudicate upon the same.
