• Undivided land, tried to acquire by a person who has been registered as owner by all members

Description:

Before 1960 there was a undevided family P1,P2,P3,P4,P5,P6 and the P6 being youngest and he is my father, P1 to P6 are higher to lower aged Person respectively.

After 1960 P1 and P2 get seperated and P3,P4,P5,P6 got united and with ansestral property income they 4 people together purchased 18 acre land at 1965 and due to the assumption P1 and P2 may come and ask for share in 18 acre land purchased then P3,P4,P5,P6 together registered to P3's son P3S1 who was 5 years old at the time of purchase.

Along with this P1 to P6's ansestral property not yet devided but their respective shares are with them, but the legal devision of land didn't happened due to P3's and P5's misunderstanding.

Now till 2018 ansestral property not devided.

P6 (My father) whose first wifes one and only son P6W1S1 filed a case stating that all property(ansestral+aquired 4 brother union+self) all property purchased by income of ansestral property. At that time and even before my father P6 offered him 1/2(50%) in ansestral + 1 extra acre and we 3 sons of second wife offered him 1/2 in ansestral and 1.5 acre extra.

(Please note among 18 acre land P6 got 3.5 acre land only)

After all this P3S1 who has his name on 18 acre(In 18 acre still sons of 4 brothers are making agriculture) started greedyness for land on his name and started trying to aquire lands of P6 who seems weak by taking advantage of P6's P6W1S1's advantage and he joined hands and took support and advantage from him and started trying to aquire P6's share of 3.5 acre with the help of P6W1S1 and his reputation/advantage of being retirded as Police(ASI) and assuming we cant Go legally and face him.

I Believe strongly that we are in a country where law is respected and even comman man can get Justice. Where a person who suffered with his life(P6W1) and he suffered by his Son(P6W1S1) by continuous courts cases and now he is cheated by person P3S1 who has greedyness of land.

I confirm that Son's of P4 and P5 are being silenced by a promise of land transfer and P3S1 compromised in aquiring P4 and P5’s share by fearing theie(Sons of P4 and P5's) lifestyle(Harmfull).

1. Now my question is which law will come in favor of P6 against P3S1?

2. As P6W1S1 filed a case of family property, If P6W1S1 participate in law breakage by influence of P3S1. What action can be taken in favour of Law and Order(As he filed a case he should wait for court decision)

Dear Sir,

From your above description I came to understand that your father has two wives and P6W1S1 is the son of first wife and yourself and two others are the sons of second wife of your father. Further I came to understand that P3S1 has turned greedy and claiming entire 18 acres of land which are purchased by 4 brothers jointly and also claiming share in remaining joint family property. It is not known what were the terms in the sale deed when executed in the name of minor that is P3S1. Further I believe that you have strong evidence in respect of 18 acres of property purchased after division (family settlement) of S1 and S2. The law is one and the same whether P3S1 is retired ASI or otherwise. You can handle the case very carefully provided you have support of all others. With this understanding I answer your questions.

My answers are as follows:

1. Now my question is which law will come in favor of P6 against P3S1?

Ans: Only under Hindu Succession Act parties have rights. They cannot be any other law.

2. As P6W1S1 filed a case of family property, If P6W1S1 participate in law breakage by influence of P3S1. What action can be taken in favour of Law and Order(As he filed a case he should wait for court decision)

Ans: Law is there to protect interest of each and everybody provided who handle the issue carefully.

1) it should be your father case that property was bought in name of P3 son for benefit of joint family

2) since son was only 5 years old he did not have any source of income for purchase of land

1. We are trying to avoid quarrel as much as possible but don't know how to deal with this situation in Police Station.

Ans: Approach Civil Court and get injunction order on the basis of affidavits of neighboring land owners.

2. If things goes wrong and went out of control. How to stop agricultural activity by any person in 18 acres of land. Is it possible to get stay on complete 18 acre land activities? Please explain how to do it.

1. If they are trying to forcibly occupy by driving you out of your property, you may first approach police with a criminal complaint and then you can file a permanent injunction suit against them to restrain them from interfering with your possession and enjoyment.

You can take both criminal and civil action against him. In case of civil action you can pray for injunction in civil court and in form of criminal action police complaint can be filed or private complaint before magistrate can be filed.
