• Unapproved plot under panchayat

We are planning to buy a house of 1500 sq ft in madurai which is coming under panchayat. There is plan approval . But the plot is not approved. It happens to be a agri land. Whether we shall proceed for purchasing?? 
We have been advised by some people to suggest the builder to go for regularisation charges. Wat is the procedure and how long it will take??

Is it advisable to buy in this situation?? Kindly suggest.

No agrcultalnd can be allowed to be sued for residential purpose by making constructions theroen

It can be used as agricultural purpose only.

However if the local law so permits the conversion of sich land for residential use cna be allowed .

So check from the local panchayat f such conversion is permissible in reality or not.

if yes then on purchase you can apply for conversion.

If there is no socy certainty then it is better to avoid this land,

Don’t purchase the house unless agricultural land is converted into NA land

2) let seller pay regularisation charges

3) if land is converted then only purchase the house

Firstly, please go and check the records pertaining to the land in near by tehsil.

Secondly, yes let it first regularised.

Thirdly, even after the regularisation go again to check the records.

Process is not so time worthy, but yes a bit complicated.

If it is not approved then you will be sitting on a volcano which can erupt at anytime. It can be sealed or demolished by the civic authorities at anytime. So do not buy it unless it is regularised.

If the plot is in an unapproved lay-out, the promoter has to apply for the scheme approval first and then the individual plot-owner has to apply for approval of his/her plot in the lay-out, in terms the Tamil Nadu GO No. 125 dated 04.05.2007, within the time frame laid down thereof.

Dear Client,

If it agricultural land than any construction on it is illegal unless use of land not converted.

Ask the Builder to first get the house approved otherwise, chances of ur money go wasted and demolition by authority.

Without conversion of agricultural land to NA, and also permission to convert again into plots, will not be proper to buy.

The NA conversion and plot approval is mandatory.

The panchayat approval is not valid, the approval should be obtained from DTCP.

Obtain legal opinion from a local lawyer before proceeding to purchase.
