The apartment which I am planning is buy is pretty new. The current seller purchased this from the builder mid of last year but didn't do the khata transfer because there were many flats vacant and BBMP asked them to wait until 80% flats are sold. Now I am buying this apartment from this seller. Can I get the khata registered in my name directly ? Apartment has also received OC this year. please advise. Also, will I be able to get the electricity etc transfer in name just after sale deed ? if Khata takes some time.

If the approval of the building is fine and there is OC and CC issued then there is no hindrance in making Khata transfer in your name.
However such things do take some time.
So you will have to wait for sometime.
I repeat if the title of the proeprty is clean and there is no issue with BBMP on the building plan then there shouldn't be any difficulty in getting Khata transfer.
1. Visit BBMP office to verify whether they have asked your seller/builder to wait till 80% flats are sold or not to get Khata registration..
2. If the above statement is correct then it is the rule framed by BBMP for their conveniyence and you shall have to act accordingly.
3. Since OC has already been obtained, there should be no problem to get the Khata registration.

I mean to ask if there is such strict rule from the BBMP that khata can only be transferred from previous owner and can not be registered as fresh? Even though no knata has been created for this flat. Owner is also ready to give me some amount which I can keep to pay pending taxes.
If building has OC then building has been constructed as per sanctioned plans
You can go ahead with the deal
However wait for khata to be transferred in favour of seller then make full payment to seller
You can proceed to purchase the flat from the present seller, and get the Katha transferred into your name only after getting it first registered in the name of the present seller, as the present seller does not have the Katha in his name.
Only after obtaining the Katha in your name, can you proceed to get the electricity meter duly transferred to your name for the said flat.
Katha will be registered after every point of sale, since the present owner/seller has not gotten the Katha transferred into his name, you will have to get it first registered in his name and later on get it transferred into your name.
1. When a flat has been purchased, Khata registration should be completed for identifying the said flat.
2. So, it is logical that khata registration should have been completed by the 1st owner being your vendor.
3. Take a notarised POA from the Vendor authorising you to apply for the khata registration for him in case BBMP insists Khata registration by the 1st owner.

The khatha is an important document to be retained by the buyer of the property.
Without khatha you may not get the electricity connection to your premises and also the water supply and other related amenities.
The khatha cannot be directly transferred to your name when there was already a purchaser in this regard.
The previous buyer has to get the khatha transferred to his name after which you can get it transferred to your name.

The khatha has to be transferred to his name first and then he can support you to get the same transferred to your name subsequently
