• Dakhila kharij agriculture land

A person sold her agriculture land in 2012 but dakhila kharij not done cause of objection so matter go to court.
 Now in 2017 seller take a kcc loan on sold land on behalf revenue record.and seller give a affidavit in bank that said no property case trial against this property.and EC from sub registrar show the name of seller.what remedy for me.agriculture land in UP.

The seller has indulged into a fraud to take the KCC loan.

Being well aware that the land was sole off by her in 2012, she could not have given the affidavit in the Banl, nor demonstrated herself to be the owner.

So that I can tell you what legal remedies you have in the instant case, please tell who are you? Are you the seller of the buyer? Or any one else?

Inform bank that land sold to you

2) enclose copy of sale deed

3) enclose copy of suit proceedings

4) bank would recall bank loan

5) sue seller if he fails to repay loan

Immediately inform the bank about the sale proceedings and also show to the bank the sale deed and other documents of suit that is pending

If seller fails to pay bac the loan then file a case against him

Bring this to the light of the Bank and place as an evidence, the 2012 sale Deedand other relevant documents.

Bank has been defrauded inasmuch as KCC loan was availed by playing a fraud upon the Bank.

The Bank may lodge a FIR.

Since the matter is pending in court, the affidavit given by the seller is not truth hence this is a fraudulent transaction.

You have to be careful about this even though there is no adverse entry in the EC nor in the village records.
