• Can I file a case against a family who are misunderstanding over gold chain stolen case?

This is Vinay. I am residing in a rented house with my mom. And a family with two daughters is residing in same house on rent. Our portions are built side by side. Yesterday they said that they lost one of their gold chains and they are misunderstanding us. They did not told us about this, but they told to the owners that we stole that chain. Seriously, I can't even think about steal something. And they said that they told this story to a preist and they are saying that some old women stole the chain. They are thinking that old women is my mom( they did not say this to us but to owners ). And they are saying that the priest is coming to our house in two days with some mantra rice to ask us to eat them, so that if we stole that chain, something happens to us. So my question can I file case against this preist and the family? Please reply me with a solution..

Yes definitely you can, go to the nearest police station and give a written complaint to them. The police will lodge a complaint against the said person under the appropriate section of IPC, do not worry.

Since nothung has been stlen fromyour house you can not ldge complaint for theft of someone esle.

if you think the priest is the culprit you can inform the police about this to assist them to cause investigation.

If any theft has occurred in someone's house the owner can raise allegations agaisnt the supsect.It is the duty of the police to find out the truth.

So if you are innocent there is nothing to worry . without having any proof the police will not arrest you.

1) you have not been accused of any theft

3) if you are accused of theft issue legal notice to them to withdraw false and defamatory allegations made against you

Write a complaint i.e. write what all you have written here on a piece of paper and then submit the same to the nearest police station.

You must report this matter to the police and if police is not taking any action then move the court either to get FIR registered or file a private complaint

You can file a complaint against them only if you have proff that they have did any imputation that will harm your reputation in public ...Than you have to file a complaint under section 500 of IPC and the complaint is produce before the presiding officer of concerned police station ...Along with your proof ...

But important thing is that you have proof of such imputation...Which will lead your case ...

They've been defaming you and causing a dent to the repute of you and your family. This is an offense under the Indian Penal Code. If you've sufficient evidence to establish their defamatory act/conduct, you may lodge a FIR against them.

Lodge a FIR against them under section 499 and 500IPC.

Yes, you can file criminal case against the persons who lost the chain and the priest. There is no seperate Black Magic Act in Telangana and A.P. In Maharastra there is a seperate Act. But there is a specific provision in Indian Penal Code against Black Magic. Before they do something on you, warn them that you will give Police Complaint. Inspite of that if they do the Mantra, you can give Police complaint marking a copy to DSP/Commissioner whichever is applicable.

File a complaint under Anti Superstition Act against the tantrik and also file complaint against the family for threatening you and defaming you.

Go to police station and get the FIR registered.

AND DO NOT EAT ANYTHING GIVEN BY PREIST.

Though there is no theft commited by you , your tenants suspected your character regarding chain stollen and cause a mental agoni to you and your mom.As the same was brought to the knowledge to priest and consulted with him as if you commited theft. Both your renters n priest disturbed your social status by way of spreading this rumour into near by inhabitant. Hence you are hear by entitled to file case for defamation and damages under IPC against both renters and priest..

A criminal defamation complaint may be filed in CJM Court against the person spreading rumors under section 499,500,501 & 502 of IPC with the proof of allegations.

However section 503 & 504 may also be considered for tarnishing the social reputation, intentional insult with intend to provoke the breach of the peace in the CJM Court

The pries or any quack or anyone cannot intrude into your house and force you to do certain things against your willingness.

You can call police if they force their entry into your house.

You have to await the neighbors to knock yor door with the priest, you can ask them making them stand outside your house and warn them of stern and legal action if they try do create any nuisance in this manner.

If they still disturb, you may cal the police
