• Installation of CCTV camera on the terrace of a CHSL without permission

Sir,I am a member of aCHSL in Mumbai.I have installed my personal Cctv camera on the terrace of the society.But I have not taken its permission.
Now the society wants me to remove it.
What is the legal status?
Whether I can continue or I have to remove it?
I have subsequently applied for the same but the society is not ready to accept the request.
What should be my stand?

To answer this, one needs to know as to what was under the surveillance of this camera. As long as no private space was being snooped by you, and a third person's privacy was not being compromised, the society should not have any problem with this.

Explain your stand to the management of the society and see what do they have to say!

What does the bye law says about this, can you install something.

However if the camera is not violating the private right of any member then the society shall not have any problem.

Tell the society officials your reason for installing the camera, rest it depends on the bye laws of the society.

Whether the society is registered or not? See terrace is a joint property of the society, If they reject your application then you can request the society to install the camera on terrace and its operation should be managed by the some society's employee not by you. If this is not satisfying your purpose then you can move to the court of law with the reason of security purpose etc.

There is no restriction in installing CCTV camera in a common space ,more so,if it does not cause any breach of privacy.

installing CCTV camera in terrace is a necessity from security perspective also.

So you may very well refuse to remove the camera.

firstly remove it with out any confrontation with the society.

You have not taken the permission of the society to install cctv camera.

The terrace is the common area coming under the control of the society hence it is pertinent that you should obtain permission before installing the same.

Since this has earned the wrath of the society and also triggered ego issues, the society may not grant permission for this at this stage.

What was the necessity or purpose to install the CC TV camera, if your reasons are justified and convincing then you may put forth all the valid points in your letter seeking permission.

If the society is not allowing you even after your request you have nothing to agitate about it than to remove the same.
