My father was a service personnel of Punjab And Sind Bank. He retired as a manager in the year 2010. At the tine of retirement he opted out of pension and got the vigilance certificate as well. In 2015 a letter came from bank asking about 2 loans which has become Non performing asset. My father replied the letter by stating that he has got vigilance clearance and further stated that he has followed all the necessary rules and gave those loans. after that no letters have come. My father wants to apply for pension now. Will he be able to apply for pension in he bank and will his pension will be approved from bank.?

1. Under no circumstances his pension cab be attached.

2.However if there is any DP pending agaisnt him and the said proceeding is relating to pecuniary loss caused to his bank then part of it can be withheld.

3. For withholding a part of retirement benefit though there has to be an order passed by the Disciplinary Proceeding.

4.Without this his pension can under no event be stopped.

If at the time of opting out there was a condition that later the employee can opt for the pension scheme then yes your father may go ahead and claim the pension.

Whether or not he can reapply for pension depends on the operative service rules. The procedure to apply would also be mentioned in the said rules.

Your father if opted for pension he is eligible for pension, whereas why did he not take any steps in this regard for more than 17 years?

Let him approach the authority with an application and exhaust the remedies before initiating any legal action.

In current scenario you can apply for pension in the bank because there is no flaws from your side.  the best way to send a letter to the bank for pension. If no action or no reply given by the bank then you can approach the high court under article 226 of the constitution by way of writ of mandamus.
