1) you should contest the eviction proceedings filed by landlord

2) take the defence that landlord has number of shops in building wherein he is earning rentals

3) state that he has other shops in his possession which he can use for expansion of his business

4) eviction suit would take 10 years to be disposed of

5) if landlord fails to make out a case he would not be granted eviction order

Delhi rent control act ke tehat agar aapke maakan maalik ko apni dukan ko expand karna hai, aur agar ye expansion ki need unki jayaz need hai, to wo aapko dukaan khaali karne ke liye ntice de sakte hain. But ap notice ke baad bhi dukaan pe apna kabza barkraar rakh sakte hain, jiske baad apka dukaanmalik court jaake rent control act ke under case karega. Is case mein unko ye prove karna padega ki unki apni dukaan ke expansion ki need bonafide hai aur unke pass expansion ke liye doosra aur koi bhi suitable jagah nahi hai.

Aap ye pata karen ki landlord ke pass is building ke alawa aur bhi koi building h commercial me, agar h to case ladiye ye kehte hue ki landlord ke pass ek aur building h delhi me aur aap ke paaas iske alawa koi or jagah nahi h business ke liye. waha vakil kariye jo rent - eviction ke case krta ho.

agar ye ground na chale to iss baat pe zor dijiye ki landlord ko aapki dukaan ki zaroorat nahi h uske business expansion ke liye.

If you are paying the rent to the landlord without defaul, you can fight the eviction suit properly in the court of law.

Before that you may issue a legal notice to the landlord to not to interfere in your possession and enjoyment of the rented property other than by due process of law.

You can immediately file a caveat petition and then an injunction suit agaisnt the landlord seeking to restrain him from dispossessing you from the rented premises other than by due process of law.

In the eviction suit you can plead all his allegations as false and seek protection of your tenancy rights on the basis of your only source of income to survive.
