Sir, I am married woman. I applied for assistant professor recruitment exam by claiming obc 3b category. During document verification they rejected my caste and income certificate because its in the name of my father nd it added my father's income. they demanded catste nd income certificate in the name of my husband. so i got converted into general category nd lost my job opportunity. whether should i go to the court to claim 3b reservation in name of my father's certificate

Your husband income abd caste is not considered for OBC NL certificate

2) only your father income or status would be considered

3) if your application is rejected you can file writ petition or application before CAT to challenge said order

you have right to claim reservation. marriage with a man of general category does not change your caste for the purpose of reservation. you should approach the high court under article 226 for direction to accept father's income for determination of your caste for the purpose of taking reservation benefit.

Actually the community certificate is issued based on the father's community and not on the husband's community for the wife.

You can take up the matter through a writ petition against the officer who rejected the community certificate to you on this ground, if otherwise your community comes under the said category.
