I have ordered some sareers from one person.I have seen posts in facebook group of Banglore wholesale market.There "Mahek Saree" named some one posted many pictures of sarees and gave one whtsapp number also to contact them to buy those sarees. I liked those sarees and pingd them.they took my order and address and told that also the courier will be sent to you next 2/3 days.I ordered on 9th September 2017.They told me to pay via paytm/transfer the amount to their bank account.I choosed paytm option and i transferred 1070 rs to 915779981(Manoj).My wallet txn Id-[deleted] and i added comment there also "Amount for two booked saree".Afterwards i am calling them to know the status of my shipment and whtsapped them but they are not giving me any replies.I have posted this to facebook also then i came know already many peoples are cheated this but the thing is no one did any report to police or facebook,Is this thing is not stopped then many others will also be cheated and this process will go on.

I went to bidhannagar cyber crime police station to Lodge the report but they didn't even Lodge my report saying the reasons like it's not under their department and I should go to consumer forum .

I need your help.Please guide me.

Offence of criminal breach of trust and cheating has been committed by fruadster under section 496, 420 of IPC

If police refuse to register FIR file private complaint before magistrate under section 156(3) of cr pc to direct police to investigate and submit report

However please note that legal fees would be higher than money sought to be recovered

This definitely come under their domain because you've been duped of your money and cheated. Besides, you have an additional remedy of approaching the District Consumer Forum.

Send your criminal Complaint to the SP by means of a registered post with a request to lodge a FIR. If the FIR is still not registered, lodge a Complaint under section 156(3) with the Magistrate.

Hii, the offence comes under cyber crime .. However the police is not taking action because of thier casual and ignorant behaviour .. You can file a complaint directly in court under section 200 Crpc ... The court can order police to investigate the matter and lodge a FIR under 156 (3) Crpc

1.The bidhannagar police is misleading .

This is a clear case of cheating and hence police cna register a FIR.

2.if not then you can approach the magistrate u/s 156(3) crpc.

1. Send a complaint to your nearest police station under copy to the DC by speed post and collect the track report of delivery from the net after few days evidencing that the posts have been delivered to the addressees.

2. If police fails to take any action with in next 30 days, file a writ Petition before the High Court against police inaction.

3. Police will be directed to act based on your complaint by the Court.

This is an act of cheating involving cyber techniques.

Therefore a complaint with the cyber crime police is maintainable.

If the concerned police is not responding properly then you may approach the higher police officer with a similar complaint seeking its intervention and direction to the concerned police to initiate proper legal action on such cheating activities.

Why did you not verify the veracity of their claim through your other sources ?

Such fraudsters are abundantly prevalent through such social networking sites, therefore it is the buyer who got to be beware of all such fraudulent activities instead of looking for remedy at a later stage when they have already stand cheated.

Approaching consumer forum on this may not fetch you any fruitful result.
