• Victimised in government job

Respected sir,
I am working in government sector in Karnataka, I had to struggle for 2 years to get this job which was to be given within one year according to law. After getting this job co-workers are torturing to leave this job. I am denied training, no place to sit. The person who had to give me training started harassing me so I complained about this to DC but to no use, I was oly transferred to dirty and unhygienic environment. It's a bus depot where toilets are very unhygienic upon which my immediate officers are humiliating me for a tiniest and silly things like I took pen of some officer to sign a paper stating I don't have common sense and they deliberately mark me absent stating ur work timings is by 8 so if u come by 9 u will be marked absent, I said if I am late ill stay late and work. To which they don't bother upon that there to no work at all to do. They say to call and ask someone if there is any work and do. My leave request is cancelled. The worst was I had given leave letter but they denied I dint give any letter and hid it, I had taken a photo copy of my letter with a manager signature on it. So this time I got leave or they wanted to send absent report and dismiss me.

Approach the High Court seeking alleging infringement of your right to equality and right to life.

All the people who have been victimising you should be made parties in this writ petition, personally.

They cannot discriminate you as per their own whims and fancies, nor can you be subjugated to unwarranted harassment.

Knock the doors of the High Court to seek justice.

Taking all the representation along you can file a writ in the high court for getting the relief, the government employee can not harass you with a malafide intention. Though transfer is not your right but to live in a healthy and safe environment is your right and you can approach the HC for the same.

1) you can complain to state commission of women against harassment meted out to you

2) denial of place to sit during office hours, making snide remarks against you that you dont have common sense, refusal to sanction leave all constitutes sexual harassment

3) the Sexual Harassment Act requires an employer to set up an 'Internal Complaints Committee' ("ICC") at each office or branch, of an organization employing at least 10 employees.

4) if no complaint committee is set up you can file complaint before SAT to direct setting up ICC to consider your complaint

The Sexual Harassment Act empowers the ICC and the LCC to recommend to the employer, at the request of the aggrieved employee, interim measures such as (i) transfer of the aggrieved woman or the respondent to any other workplace; or (ii) granting leave to the aggrieved woman up to a period of 3 months in addition to her regular statutory/ contractual leave entitlement.

Your problem is that you are not attentive or regular in yor job hence yo are forced to face problems like this.

This is just temporary, if you want to overcome it you should be very patient and strong minded person so that you dont take anything personally or feel affected or suffer mental strain on this.

Look for the opportunity to get transferred to some other place where you may find some relief and peace.

You consult an advocate and draft a complaint letter to the top management expressing your anguish and narrate the suffering, humiliations faced and the tortures by the fellow employees on even silly things.

If there is no response to this also then yo may plan to initite proper legal action on this as per the provisions of law in this regard.
