you ought to have applied to collector for conversion of land into NA before carrying on 1500 square feet construction

2) then applied for sanction of building plan from gram panchayat

3) Under section 44 of the Maharashtra Land Revenue Code 1966, before carrying out any development on the land, an eligible person has to apply to the collector for the permission to convert the use of agricultural land for any non-agricultural purpose, or to change the use of land from one non-agricultural purpose to another non-agricultural purpose.

you can apply for regularisation construction done on agricultural land

Maharashtra govt has taken policy decision to regularise such unauthorized construction on payment of fine as they are not on govt land and there is no reservation of such land in larger public interest

you can apply for regularization of the land before the appropriate authority for the change of land use, Govt. usually does not deny such application as a part of policy decision.

New order makes land use change easier in Maharashtra. According to the new order, the premium will be charged according to the demand for change in land use. The new order has been issued under section 20 of the Maharashtra Regional Town Planning Act, 1966, which allows conversion of land use for a premium.

As per the new order by Maharashtra Govt., which seeks to make it easier to change use of big parcels of land, from 10 hectares to 25 hectares, for a premium that ranges from 20 per cent to 75 per cent of the ready reckoner rates. Earlier such conversion of big parcels of land was done at the Chief Minister’s level and the process would take at least 2-3 yrs. Now, the process should be completed within 90 days.

The collector's nod, which was so far mandatory, had given rise to complaints of undue delays and corruption.

Land owners will have to seek the permission of the municipal body for their non-agricultural plans. Once the municipal corporation or municipal council gives the go-ahead, the owner just needs to intimate the collector in 30 days. No permission from the collector is required. Revenue officials will then recover a one-time land conversion tax and a non-agriculture cess.

This process will apply to those who are direct owners of the land. For those who have leased land from the government, the collector's permission is still required, though the conversion procedure has been made simpler for them as well.
