• Co-operative group housing society case of over selling and delay

The matter refers to the cooperative group housing society of Gurgaon, The previous management oversold the flats in the group housing cooperative Society project and have delayed the completion by more than 7 years. There are also issues related to the plot which was EWS category and had initially 40 units, these 40 members sold their rights to new management who later on got the FAR increased to 94 units and to get new 94 members the previous management oversold to nearly 190 members. What can be done in this case. Can I go ahead and complete one unit on my own, since it's cooperative society and starting living? I have bank loan also, can that be put on hold till the matter gets resolved ?

selling of 94 units to 190 members by the management , knowingly leads to economic fraud .. If such is the scenario , then file a complaint in the economic cell Gurgaon .. as per your unit , you can file a compensation in the consumer court , to recover the amount ( if you want to withdraw from the unit purchased ) with interest .. The court can grant stay on further instalments till the final disposal of the case

1) previous management have committed offence of cheating , criminal breach of trust as the sold 94 units to 190 members

2)if there is no stay order passed court you can after getting building plans sanctioned complete construction and start staying on said plot
