I had taken a token amount of 4 thousand rupees for the sale of my car with the condition that the rest of the money would be paid the next day.The next day the person who paid the token asked for a few two more days.As I was on a tight schedule I sold the car to some one else.I offered to return twice the token amount but the guy is not accepting.He is threatening me with police case.What are my options. 1. Send hima legal notice giving a firm 7 days time.
2.in defaultyou send his money through Money order or send cheque.
3. Then you proceed to sell the car.
4.For dispute of mere Rs.4000/-no criminal case would be initiated.

As long there was not agreement to sale, duly executed and registered, there is no need to worry. No police case is maintainable in a transaction which is purely civil in nature. Police will never act upon on his complaint.

If no receipt was there then he can not take any action and moreover if he files a police complaint you can easily take the defense that he himself delayed the purchase of the car.
If he calls you now again you can say that go ahead and file a complaint in the police, or another thing is you can go to the police first and lodge a complaint that he is threatening you.

Have you entered into a sale agreement, if not then dont worry about it.
Let him go to court or police station, you can narrate the incidences and should express to return the advance amount obtained from him.
I have plans to go abroad for my education, would there be any issues in leaving the country if he registers a false complaint. He is asking me to pay him 15000 to not register a complaint.
There is no need to pay money, but the other side of the story is if he cooks up a false story then police might register a complaint against you. I have already suggested you and I repeat again that you can go and lodge complaint in the police station and say that he is doing such and such things.

Don't reveal about your abroad travel plans to him.
Ask him to proceed with any case, tell him that you are ready to pay him the money he paid you, if he is not willing to accept let him take any action, you can challenge it.
This will not hamper your abroad travel program.
