• Mutation of property

My Father had a lease hold flat in Ghaziabad which he willed to me 5 years back.
He died last year and now I wish to transfer the property in my name.
Please advice the procedure and expenses.
Its a 1000 sq ft GDA flat.

The charges, procedure and the documentation for conversion from leasehold to freehold depends upon the location and size of the plot. I'm afraid that you'll have to visit the GDA office and get the precise details as to charge and procedure.

1) apply for mutation of flat in your name

2)enclose copy of father death certificate

3) copy of father will

4) proof of payment of property taxes

5) identity and address proof

6) notice would be issued to all legal heirs

7) if no objection received flat would be mutated in your name

You will first have to apply for probate in the following mnner:

an executor of the Will or an heir of the deceased testator can apply for probate. The court will ask the other heirs of the deceased if they have any objections to the Will. If there are no objections, the court will grant probate .A probate is a copy of a Will, certified by the court. A probate is to be treated as conclusive evidence of the genuineness of a Will. In case any objections are raised by any of the heirs, a citation has to be served, calling upon them to consent. This has to be displayed prominently in the court. Thereafter, if no objection is received, the probate will be granted and It is only after that Will comes into effect.

And after that you can approach the registrar and get the title transferred on your name.

You can go and visit the sub registrar office of the locality where the property is situated to get the payment details as the fees depends from place to place.
