What happened if in a criminal case if stay is rejected from session court in a section for e.g 307 is there any chance to arrest by police ,and how much time does it take to get bail from high court.

If your bail has been rejected from the session court then you can apply immediately in the High Court for bail and if your case is strong you will get bail on the first day itself. And police can arrest you any time if you dont have any stay from any of the court.

If your bail application has been rejected by the Sessions's Court in the FIR lodged against you under section 307, approach the High Court at the earliest, seeking anticipatory bail if you have not been arrested of regular bail, in case you have been arrested. Also, if you have strong grounds, you may also approach the High Court under Article 226 for the quashment of the FIR itself. The High Court should take a decision on the bail application moved by you within a week.

on the first day itself you will get the interim relief which will be in the nature of interim relief, High court does not take much time in deciding the matter of bail. It does not mean that you will necessarily get a bail but if have a good case you will get in on the first date itself.

It may take one week to 15 days for a bail application to be disposed by high court, especially if the police report is awaited then it may extend upto 1 month also.

If the sessions court dismisses your application for bail then you may apply for bail before high court.

If there is no bail or order by court to stay arrest, the police may arrest you immediately.

Hence better go underground till you get bail to safeguard yourself.
