• De-registering my marriage in India after my divorce in Singapore

I am an Indian citizen who is working in Singapore. I got married in India; however, due to irreconcilable differences i got divorced in Singapore by mutual consent.
I would like to re-marry now. is it necessary for me to de-register my marriage in India? If so, what's the procedure for it?

If a divorce that took place in Singapore then that decree is valid in India as well, then you are required to again register your marriage in India, just in order to avoid any future complications.

There is no provision for de-registering the marriage here in India.

Such a thing is unknow to Indian laws.

The dissolution of marriage by mutual consent in Singapore is recognised as valid divorce in India, hence your may not worry about re-marriage in India.

you can very well go ahead with your proposal to marry another person again in India on the basis of divorce decree obtained in Singapore on mutual consent grounds.

Well.the divorce granted in Singapore is not valid in INDIA.

So if you remarry and if your wife disputes the divorce done in Singapore she can file criminal case of bigamy.

I would advise you to do mutual divorce done in India so all future disputes can be avoided.

You can vpid to do this only if your wife has remarried in india .

In India

There is no procedure or provisions in law for de-registering a marriage in India.

Once a marriage is registered it will remain registered in the register of the registrar of marriages.

The validity of it will have to ascertained if there is a decree of divorce or dissolution of marriage by a court of law and its validity or effectiveness.

1. Decree passed by the foreign court is not valid in India unless the case has been filed based on grounds acceptable by Indian law.

2. Mutual consent is the only ground for availing MCD decree which is valid in India as well as Singapore.

3. However, such decree passed by foreign court is required to be validated by local District Judge to be enforceable in India otherwise you two shall still be treated as married couple in India and will not be able to marry in India legally.

4. So, get your said MCD decree passed by Singapore Court validated by local District Judge in India after which you shall be free to marry again in India legally.
