• Regarding business model

I have made a website in which a user pays 1$ to play. He gets a question if he answers it correctly he gets back 2$ else looses his money 

Now if I say in terms that this is our business model and the users whomsoever are continuing are not from areas in which this model is banned by law or any other authority.

Will this be legally sufficient or it won't be. Please help

This is nothing but a gambling business which you want to give legal paint.

Well there are many other points that are to be taken into consideration, you may look into them too.

The terms of acceptance forbidding the players hailing from a restricted area is a good idea, you may think about many such ideas which would safeguard your business and defend your interests in the business

Could u please suggest some other ways. Also if I use the way which I mentioned in the previous question would i be legally insulated or I can still fall in any fix?

You can add disclaimer clauses for the losses they may suffer due to their ignorance.

The authenticity of the genuine players have to be substantiated with the organizer by submitting any valid id prof which would facilitate the organiser to sue or initiate any legal action as per provisions of law i case of breach of trust or suppressing the facts material to the grant of permission to participate in the business games.

1. gambling is banned in India and many other countries.

2. gambling and skill are two different things. game based on skill however it prima facie seems like a gamble does not come under gambling.

3. according to section 30 contract act, game based on skill is legal. in your case if question is based upon skill then it is legal.

4. this model cannot be banned because it is based upon skill.
