Respected sir I am gyanendra a labour contractor from odisha,my problem is I mobilize17 worker & 2nd phase 16 worker to vellore from my own expences after the company contract person giving me the offer of rs 450 for skilled worker &Rs350 for unskilled worker and mobilization beared by the company but in time of billing they deny all promises and tell me that ur measurement bill is 49000 and we are not giving on NMR, but worker payment due is 160000.I don't understand what to do the worker are theatning me.please help.

Prepare transcript of audio recordings and enclose it to your complaint
1. it can easily be proved that these labourers are working in the company.
2. company cannot deny it.
3. statement of these labourers are admissible because without offer from the company they could not move from their native place.
4. you should file a criminal case for the offence of criminal breach of trust and cheating.
5. no written contract is necessary because circumstances of the case itself prove the fact.
Whether you have entered into any contract for supply of labor and the rates have been fixed in the agreement?
if not then you dont have bright chances to recover the amount due to you.
However you may send a legal notice to the hirer demanding the balance amount to be paid by him as per the agreed conditions of the labor contract entered between you both orally.
Let him give a reply and commit himself, you can look for the options to file a recovery suit after that.

The phone conversation may be quoted as oral agreement for the legal notice to be served on the opposite party.
