• Legal opinion forex

Dear sirs,

We are looking form a legal opinion, stating that we as a Cysec (Cyprus) regulated investment company are allowed to accept traders from India.
Please note we do not activelly do any marketing in India to consumers.

If you wish to run a business of forex trading you will have to set up a company herein India and acquire necessary licenses from RBI and SEBI in that regard.

In India forex trading is not allowed

2) if any person from India is found trading forex instruments on the forex market action would be taken against him under FEMA 1999

3) in addition he he would be considered liable for violations of the KYC policy and money laundering standards

4) it is legal to trade forex with Indian exchanges only

You belong to Cyprus and want to do trading business with Indian investors?

What is the opinion you want when you follow and comply with the procedural aspects as envisaged in law of both the countries.

This will be based on the laws of both the countries of course you may have to verify the credentials of the Indian trader and confirm genuineness before accepting any such agreement.

1.India has an open economy with little regulation.

2. You can form a subsidiary or associate company in India and trade your product through the said company like any other multinational company doing business in India.
