Dear sir, My wife took mobile numbers of some of friends and colleagues and communicating with them. Although I am not having any black/white proof but its facts based on logical and incidental occurences. Can I file divorce and request court to get call and whatsApp records of certain people. Dear Querist
being a Muslim Husband, there is no procedure for you to file divorce case against your wife if the marriage was solemnized as per Islamic Law.
The phone call recordings and the whatsapp calls or chats cannot be a substantial evidence for seeking divorce.
The act of adultery is to be proved properly before court beyond doubt or else the same may not be maintainable.
