• OBC non creamy layer certificate for migrant domiciled in Mumbai

My father is a class 3 employee in central government of India. He was recruited in class 3 category. Now his annual income is more than 6 lakhs. I am born and brought up in Mumbai. I have domicile of Maharashtra and also have been issued OBC caste certificate from Maharashtra for migrants. I wish to seek reservation for OBC for central govt and PSU jobs, and for that I have to make central OBC certificate with non-creamy layer clause. I feel am eligible for that , but many people told me that since my father's income is more than 6 lakhs I am not eligible for OBC non creamy layer certificate. Please clarify , I come under non creamy layer or not ? If yes , What are the procedure to make central OBC certificate with creamy layer clause ?

You fall within OBC non creamy layer

2) as per the Central creamy layer criterion II & III dated 08.09.1993 only the sons and daughter of following “government servants” will be treated as creamy-layer.

(i) Parents, either of whom is a Group-A officer. (Direct Recruitment)

(ii) Parents, both of whom are Group-B officers. (Direct Recruitment)

(iii) Parents of whom only the father is a Group-B officer and he gets into Group-A at the age of 40 or earlier.

2) in your case you would fall under OBC NCL as your father at age of 40 is class 3 govt employee

3) for government employees only their position in the office is the criterion for non-creamy layer status. Excluding all Class I employees and direct recruits of Class II cadre, all other govt. servants having income greater than 6 lakhs are still eligible for the OBC non creamy layer certificates

If you belong to OBC community then you are eligible for NCL certificate also.

Your father's salary income is not a criteria for determining the annual income, the salary income and income from agriculture is not taken into consideration for income limit beyond 6 lakhs per annum.

You can very well apply for the OBC NCL certificate with the jurisdictional revenue department
