• Divorce paper related

I filed divorce case. After one and half years .. Her side demanded 23lac . Because of her only I lost my job my reputation everything. Now her advocate & my advocate are forcing me settle one Time by how ever. But ln last hearing, I spoke with judge of main court that I can pay only partially and asked time to settlement periods of 1yr. So judge said ok and ordered to be come for documentation on this 23rd . That day my advocate did not appear intensely. Now he is telling that if you go for partial settlement you can't get divorce paper and all. So go for one settlement . Can't I get divorce paper until my full payment?

2) under terms of settlment you can pay your wife X money over period of one year

3) if wife is agreeable court can cobcert existing petition for divorce into divorce by mutual consent

Hi, As per law, though the court and you wife agreed to receive the partial payment and remaining amount after completion of 1 year, but case is not closed till you make full payment.

2. So untill then you will not get divorce and you can't remarry.

1. There is no force to settle the case at all.

2.Get the case fianlly decided on merit .This wouls save your money.

3.No one can force you to settle the case or pay such amount of money if you d not want to settle the case.

If you seek time for settlement of alimony amount then the court may not pass divorce decree of judgment until the full settlement is made.

If you have arrived at a negotiated amount, then you may seek time for settlement but remember that until the entire amount is settled she may not agree for divorce hence the court may adjourn the matter until then or it may not wait till then and it may pass orders as per the prevailing circumstances.
