• Full and final settlement pending for 2.5 years

My ex employer is not giving full n final settlement amount. Its been 2.5years after getting out of the company. Need Help in recovering the money and need to be compensated for all the trouble faced due to this.

My last month salary, gratuity, incentive, etc ... its almost Rs 5 lac is still pending from them.
they are event not replying to my mail .

What are my options and how should I go about it?

1) issue winding up notice to company for non payment of dues

1. Withholding of legitimate dues of an employee is a criminal offence for which you can seek legal remedy under criminal jurisprudence.

2. SO lodge a complaint of criminal breach of trust and cheating u/s 406, 420 IPC and once the FIR is registered then see how fast you get your dues paid.

3. For Lodging a complaint with the Police no lawyer is required.

4. If FIR is not registered on the basis of your complaint then only you would need a lawyer.

1. Have you served him a lawyer's notice? If not then issue it forthwith.

2. If the amount is not released even after notice from your lawyer then file a civil suit for recovery of money in the court.

If the company is not responding to your communications then you should have sent a legal notice to the company demanding your dues.

Even now you can issue a demand notice through a lawyer demanding your entire arrears including F&F settlement with interest from the date of its due.

After that you can adopt the legal process of recovery through court of law.
