• How to make formal agreement for Road Access

I purchased an agriculture land near Hyderabad which doesn't have road access, however neighbor land owners agreed to provide an access through their land (aprx 0.4 Acer) with certain amount as they can't cultivate this part of land. And this newly formed road will be on sharing basis. Please advice me how to make a formal (or legally bounded) agreement for this road access to avoid future issues.

1) you must get agreement drafted by local lawyer

2) agreement should mention consideration to be payable by you for access of road

3) it should also mention that rate would not be revised arbitrarily without your consent

3) agreement should mention that you would have access through motorable road and you would be entitled to take your car or bike across the road

4) agreement should provide that in event of disputes arising between parties it would be referred to arbitration of sole arbitrator to be appointed between parties

5) agreement should be duly stamped and registered

First of all it is not advisable to buy a landed property to which there is no access to road or there is no easement.

Well since your neighbour agreed to share the pathway on some price you may get a sale deed executed in your favour for the rights instead of just an agreement

1. you should prepare a deed regarding easementary right over the property.

2. it should be perpetual so no time limit for its use.

3. must mention a clause to protect your interest like it never be encroached by anyone, no permanent structure shall be built over it etc.

you must register this deed in the presence of two witness. deed should be written on rs 100 stamp paper.
