• Defamation due to writing on public platform Google review

I have been issued a legal notice of defamation by my previous employer for writing a bad review about their management and their company on Google review. I had not written the review but someone used my google sign in on my computer to write that review for the company. Since my name and my photograph appears in that review, that company is filing a defamation suite against me for 25lakhs saying that I had affected their reputation. Can I defend the case?

you should lodge police complaint against person who used your email id to write bad review of the company

2) under section 66C of IT Act Punishment for identity theft. -Whoever, fraudulently or dishonestly make use of the electronic signature, password or any other unique identification feature of any other person, shall be punished with imprisonment of either description for a term which may extend to three years and shall also be liable to fine with may extend to rupees one lakh. ]

3) engage a lawyer and reply to the legal notice . mention that review was not posted . by you

4) enclose copy of the police complaint filed by you

5) in addition on google review site post clarification that bad review of the company was not posted by you . your email id was hacked and bad review posted . mention that you have filed police complaint against unknown person who hacked your email id

1. You can jot take this plea since your a/c was used for the same.

2.if you indeed did not make that post and your ac is hacked then lodge complaint with the cyber police and if on investigation if it established that your ac is hacked then only you can be saved.

3.otherwise the prosecution of defamation if filed would be initiated agaisnt you and you may find it hard to defend yourself.
