• Purchase of agricultural land in Karnataka

Sirs, 
I am from a business family in Chennai with our family income less than 25 lakh. Currently we do not possess any agricultural land. My father had agricultural land in Tamil Nadu which was sold in 1995. I wish to individually purchase agricultural land in Karnataka and have located an acre in Chikabalapur.

1. As I am a non agriculturist does the amendment(2015) allow me to legally purchase the agricultural land. 
2. I am also given to understand I can purchase the agricultural land and then seek permission from the Deputy Commissioner to regularize the purchase. Is this permission discretionary? I do not want to be at the mercy of the Deputy Commissioner and risk losing the land to the govenrnment. 
3. Would i be able to apply for pahani from land that was already sold off in 1995.

1. according to section 63 of the land revenue act, a person having no agricultural land or land below the limit of ceiling he can purchase agricultural land up to 10 acre.

2. such permission is required when buyer wants to change land use or where seller belongs to schedule caste.

1) amendment act allows you to legally purchase agricultural land

2) it empower Deputy Commissioner instead of Assistant Commissioner to grant permission for non agriculturist to purchase agriculture land under section 80 to take more caution while granting such permissions;

(3) Permission is at the discretion of deputy commissioner

Since your father was having agriculture land in Tamilnadu you get a certificate from the concerned VAO about this and can keep in your possession for production in case it is necessary while getting the property registered in your name.

Even non-agriculturist can buy agricultural land in Karnataka with income upto the extent of Rs. 25 lakhs. Non-agriculturists who purchase farm land under this amended Act have to use it for agricultural purposes only.
