• Interior designer not completing the work

Our interior designer has not completed the work. Initial work was done in our flat by them after which we gave flat back to builder for pending work. When builder gave us the flat back We asked the interior designer to complete the rest of work. They want to start the work after a month, but since we are already staying in rented accommodation we don't want to delay possession. So we hired external carpenters, electricians to complete the work. Interior designer also didn't deliver many items which were included in initial quotation. Can we file a legal case against Interior designer and ask for compensation. We don't have any agreement on stamp paper with them but do have email trail and online payments done to prove the transaction and agreement we had with them.

you can file suit for damages against the interior designer for failure to complete work with in period stipulated in the contract and claim loss suffered by you

1. Emal communication is valid proof of agreement and you can reply upon it show the services you hred and the services you got.

2.Even verbal consent is laos valif agreement through bit difficult to prove in court.

3. So if you think you did get the money'worth of services or there efficiency of service you can file case before the consumer forum seeking damages, refund and compensation.

1. It is most unwise to hire an interior designer for a work like this without an agreement. If you go to court now it will be very difficult for you to prove what is the work that he had to do and what part of it is left undone.

2. If, however, you have sufficient social media communication with this interior designer to prove that he has not done what he had agreed to do then you may file a suit for damages against him.

If the interior designer was engaged by a contract entered with him by you and is not a part of the builder's incomplete work, then you may initiate legal process against the designer demanding either compensation or completion of work immediately.

You may issue a legal notice demanding the reliefs, if he is not complying then he may be dragged to the consumer forum for deficiency in service and compensation thereon besides recovery of dues.
