• Compensation of land acquisition by NH 18 for bypass road

Hello sir myself Janakiram. I have land of 7Acres in Lakshmipuram village, kallur mandal, kurnool district. recently around 0.72Ac of land has been acquisitions by NH 18. As per the Sub- Register office the market value per acre at that village is 18,00,000/-. My question is how much compensation will i get and what is the procedure to get compensation. Please can you tell me in brief.

1) as per new land acquisition Act , in u rban areas, compensation is twice the market value of the property, plus 100% solatium on this amount

2) * In rural areas, compensation is four times the market value of the property

3) Market value' is determined based on sales and purchases made at sub-registrar offices

4) Section 30 of the Act of 2013 makes a provision for awarding solatium @ 100% of the total compensation which is required to be paid

Road Transport and Highways Minister Nitin Gadkari had announced recently that government is mulling higher payment to farmers and is also contemplating equity for them.

"The Ministry has directed NHAI, NHIDCL and others to enhance compensation to farmers as per provisions of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, (RFCTLARR Act) 2013 in cases were award was fixed as per old law but compensation has not been paid to land owners.

In the event if the amount determined by the competent authority is not acceptable then on application of the parties it will be determined by the arbitrator. (Section 3G (5) NHA)

The NHA prescribes for issuance of intention notification for acquisition of land, decision on the objections if any from the affected persons that results in issuance of declaration notification. On issuance of declaration notification the land stands vested in the Central Government free from all encumbrances. After this the ‘competent authority’

adjudicates on the compensation aspect for the acquisition of land and other incidental damages. On the deposit of the compensation as per the award of the ‘competent authority’ the Central Government on giving notice to the affected persons can within a period of 60 days take possession of the land. In the event of any opposition to this activity the act empowers the authority to take help of the district administration in taking the possession of the land. In this manner acquisition of land is speedier but iniquitous.

1. before acquiring land the collector shall give a public notice regarding area of land, map and particulars of land going to be acquired.

2. collector shall also bound to give rate of per acre land fixed for the compensation.

3. after publication of notice you have right to file objection if rate is below the market rate or any discrepancy in the notice.
