• Subdivision of land in Andhra Pradesh

Quick question - can any piece of land be subdivided into two pieces ? my father plans to sell off half his land in andhra pradesh and construct a house in other half. there is lot of doubt of subdivision and how to do it.

The builder is saying that this is not possible and to make a contract for half of land and do construction in other half (without subdivision).

But we are not very comfortable with this.

If this can be done, what is the procedure and how much will it cost for a lawyer to do this?

subdivision of land can be done in AP . you have to apply to tehsildar of sunb division of land

PATTA SUBDIVISION :

(i) The Tahsildar concerned will receive application from Meeseva

and entrust to the Surveyor for survey.

(ii) The Surveyor concerned will intimate in advance of 3 days to the

applicant and neighbouring pattadar about the date of

conducting of survey.

(iii) On the day of survey, the surveyor under intimation to VRO will be

present at the site with necessary records and conduct survey in

the presence of applicant and neighbouring pattadars as per

enjoyment on ground. Necessary statements has to be obtained in

prescribed proforma as designed in Meeseva.

(iv) After conducting of survey, the surveyor will prepare sub-division

record duly sghned by the Tahsildar concerned and submit to the

Dy.Inspector of Survey, RDO office for technical scrutiny.

(v) The Tahsildar has to sanction subdivision and necessary

proceedings has to be given for carrying out incorporation of

changes in records.

(vi) The Surveyor will carry out necessary changes in records

I,e.,RSR/SFA and FMB.

(vii) The VRO concerned has to carryout changes in no.3 Account.

(viii) Patta Subdivision shall be taken up where the applicant has to

show specific enjoyment with well defined ridges.

(ix) Patta Subdivision shall be taken up where the neighbouring

pattadars have no objection for subdivision in respect of common

boundary and to sign in subdivision statement in appendix -VII.

(x) In case of joint property all the share holders shall give consent for

patta subdivision.

(xi) Patta subdivision can be taken up where there is no court case is

involved in respect of title and possession.

(xii) The applicant has to produce clear cut title over the land.

you can apply for Subdividing a Land to the Sub Divisional Officer or the concerned Tehsildar in your area.

Go to the Tehsildar office in your area.

Apply using plain paper, specify mode of acquisition of land with a draft proposal for sub division, then affix a Court-fee stamp of 75 paise on the form.

The filled in application must be signed by all co-tenants.

Submit your application along with all the required documents.

Your application will be forwarded to the Deputy Commissioner's office, where it will be reviewed. It's approval will depend on comments and recommendations gathered by the Commissioner

if the land is small dont go in for subdivision

it is better you sell the entire land to the builder and with sale proceeds buy another land

Division of a small piece of land is always a losing proposition. Better sell the land as a single unit to fetch the market price.

A portion of property if sold, then that portion of property is entitled for a sub-divided patta or for sub-division.

Sub-division has nothing to do with the construction of building in the other half.

If the builder is ignorant of law, he may be changed.

The sub-division work can be done directly by you by submitting an application to the Tahsildar giving the details, The cost would be very low and marginal if you handle the subject yourself, an advocate has nothing to do with this.

We have been told by builder that our land of 800 sq yards is too small for subdivision. Instead he is suggesting to go for different door numbers in both the plots.

Even if you get a different door number, the division has to be ensured. May be sub dividing the property may not become necessary if you are able to get another door number.
