Mere Dada ke 4 ladke aur 2 ladkiya hai. Gaur Singh, Jaynarayan, Nandlal, Ishwar, Shamti, Tijiya naam hai. Unke paas 4 acre 90 dismil jameen thi. Jisme se 4 acre unhone bech diya tha, Alag jaati ka hone ki wajah se Kharidne waale ka naam nhi chada tha, Baad me mere dada ke 3rd bete mere papa Nandlal ne apni service lagne ke baad pure 4 acre jameen ko wapas kharida aur apni 15-16 saal ki kamayi apne maa pitaji aur bhaiyon ke dekh rekh me laga di . Jiski wajah unke chhote bhai ishwar aaj CISF me Naukri kar rha hai, Jaynarayn kheti kisaani karta h aur Gaur Singh ko 10th class me mere Dada ne ghar se nikal diya tha , wo bhi CISF se retired h ,jisne apne bade bete hone ka koi farz nhi nibhaya . 25/05/2016 me sabhi bhaiyon me batwara hua , Ishwar aur Jaynarayan jisko mere Papa ne Paala ,unhone batwaare ke time par kisi bhi gaon ke aadmi ko nhi bulaya , aur jab humne bola ki sarpanch ya fir patwari ko bulao to unhone bulane nhi diya aur jab mere Papa ne kaha ki agar tumlogo ko sarpanch ya patwari nhi bulana to mat bulao magar maine jo mere service ke 15-16 saal ka saara paisa parivaar me lga diya uske hisaab se thoda jyada jameen milna chahiye. Ishwar aur Jaynarayan ne mere Papa ki baat ko FARZ bta ke taal diya . aur jo batwara hua usme jameen kuch aise bati - 
Ishwar - 1 acre 60 dismil ; 
Jayanaran - 1 acre 8 dismil ; 
Gaur singh - 95 dismil;
Nandlal (mere papa) - 90 dismil;
Dono betiyon ko Batware me hissa lene se inkaar kiya aur unhone jameen ke badle chaaro bhaiyo se paise mange

abhi khata alag nhi hua h 
registry 26/05/2016 jis din batwara hua usi din ho gaya 
mere papa ko pichle 1 1/5 saal se kuch dikhaai nhi deta 
aur ye jameen hi ab humara sahara h ye jaante huye bhi aisa batwara kiya gaya hai
Ishwar ne patwari ke paas jaane ki jagah tehsil office se map ka copy nikalwaaya aur sabhi bhaiyo ko dikha kar bola ki ye map patwari ne issue kiya hai aur bola ki isi ke hisaab se batwara hoga



mera question hai :
Kya ye batwara sahi hua?
kya ye batwara fir se kar sakte h?
Registry cancel ho sakti h? Agar ho sakti hai to kaise hogi (procedures)?
Kya mere dada ke bade bete Guar singh jisko ghar se nikaal diya tha uska bhi jameen par hak h?
kya kisi ke asahmat hone par bhi batwara ho sakta h?(hum is batwaare se ashahmat h)
plz humari madad kare aur hume helpful suggestion de ...

batwara sahi nahi hai

2) par woh batwara regsiter hua hai aur aap ke pitaji ne us par sign karen hai

3) yaadi aap ke pitaji ko force kiya tha sign kare ke liye woh court me aarzi dal sakhte hain partition deed ko set aside karne ke aur phir se batwara mang skahte hain

4) gauri singh ka haak hoga jameen par kyunki dadaji ne wasiyat nahi banayi

1. Batwara sab bhai milke kiya. Lekin koi bahin ka koi khag nehi mila. Agar koin bahin us batwara deed me sin nehi kiye to uh batwara illegal and invalid hai. lekin is mudda ko bihin logonei utha sekti, bhai log nehi kiunki sab bhai logo us batwara par sign kiye.

2. & 3. Us batwara deed ka cancellation deed registry korna parega jahan sab bhaio ka sign chahiye. Agar koi sign korneka liye inkar kare to bahin logo ko partition suit file korna parega aur court order se jamin ka batwara hoga. Court Commissioner uh batwara karega.

4. Apka Dada ka sab ledka aur ledki ka (apka Dadi ke bhi, agar uh jinda hai) saman hak hai unka property ka upar.

5. Apka pitaji ne us Batwara deed par sign kiye hai. Apka asahmat honese koi farak nehi parta.

6. Apka Aunty logoko or jis uncle ko ghar se bahar kar diya giya tha unko boliye ke partition suit file kare. Court partition kar denge aur purana Batwara deed cancel karneka order de denge.

The family partition depends on the mutual agreement among members but if the property was subsequently bought by somebody on his individual's name, then it will remain unpartitioned because others have no right in it.
