Sir, I was interviewed with an offered a Job with a private Startup in Delhi, I was offered the Offer Letter as Bus. Development Mngr. on mail. I joined the company, and then after a month when the salary was due for September, they said that it will take a week more due to some fund issues. I never got it, and was still working, when on 13th October they told me that they told me they cant afford me here in Delhi and offered me the same role in Chandigarh, I said no to that and we mutually decided that 30th of October will be my last working day. After That I joined another company, but the previous one kept reassuring me that I will get the payment with a little delay, after a lot of effort they paid me 16000 Rs. and are refusing to pay the rest, citing lack of funds, while the company is still running. Please tell me what legal options I have, the pending amount is only Rs. 53500, but its my hard earned money and I want it, I borrowed some from my friend thinking I will pay back from the salary. I want legal remedy, what options and chances I have for this, also the steps to be followed for the same. Thanks

Sir, The company is still functioning, so how can I file a liquidation petition? Will the court accept liquidation petition for a mere Rs. 53500? Also is there any other way for that?
If company is unable to pay its debts winding up petition can be filed
2) you have to issue winding up notice before filing petition
3) the reason I suggested winding up petition is court fees are nominal
4) court would accept winding up petition even if amount involved is Rs 53500
5) in alternative file summary suit under order XXX VII of code of civil procedure to recover your outstanding dues

Firstly send a legal notice to your employers to release the balance money without any further delay. If they do not reply file a complaint to the concerned labor commissioner.
Being a startup they would not want to get into any legal troubles and hence might act to your legal notice itself.
